UPDATED: Man charged with second-degree murder after body discovered near Radium

RCMP confirmed a 41-year-old man has been charged following the recent discovery of a body east of Radium, B.C.

Philip Toner, who was arrested Tuesday in the Okanagan, was charged with second-degree murder in connection with the death of 35-year-old Brenda Ware.

The body of Ware, who lived near the Alberta towns of Sundre and Cremona, was located near her vehicle on May 6, 2021, approximately 50 kilometres east of Radium along Highway 93 in Kootenay National Park.

Ware has gone missing earlier this month.

Toner appeared in Kelowna provincial court Wednesday morning ahead of his scheduled return to Alberta.

Person of interest in suspicious death investigation located

RCMP wishes to thank the media and the general public for their assistance and tip information after Philip Toner was located earlier Tuesday morning by the Lake Country RCMP.

RCMP previously identified Toner as a person of interest and an individual police were looking to speak with in relation to the suspicious death investigation of Brenda Ware. 

“Major crime investigators continue to pursue all avenues of investigation into the suspicious death of Brenda Ware,” said Acting Officer-In-Charge (A/OIC) Supt. Sanjaya Wijayakoon of the BC RCMP Major Crime Section Tuesday in a media release.

“There continues to be no known threat to public safety at this time.”

RCMP continues to urge anybody who has any information about Brenda Wares’ death, or can aid investigators in establishing the timeline leading up to Brenda’s death, to please contact the SED Major Crime Unit Information Line at 1-877-987-8477.

BC RCMP seeking the public's assistance in locating person of interest in suspicious death investigation

In a media release Monday, the BC RCMP Southeast District Major Crime Unit (SED MCU) said it is seeking public assistance in locating Philip Toner, who is a person of interest in the suspicious death investigation of Brenda Ware.

RCMP said Brenda Ware’s body was located on Thursday May 6th, 54 kilometres northeast of Radium, BC along Highway 93 in Kootenay National Park.

“Brenda Ware and Toner were known to each other; however the nature of that relationship will not be released at this time. Investigators are interested in speaking with Philip Toner, 41, as soon as possible,” said Acting Officer-In-Charge (A/OIC) Supt. Sanjaya Wijayakoon of the BC RCMP Major Crime Section.

RCMP said Toner’s current whereabouts are unknown; however he has ties to both British Columbia and Alberta.

Toner is described as:

  • Caucasian male
  • Brown hair
  • Bald
  • 5’11”
  • 190 lbs

“If Philip hears, or sees this call for information, we ask him to contact the police of jurisdiction,” says Supt. Wijayakoon.

Anyone who may encounter Toner, should not approach and immediately call 9-1-1.

BC RCMP seek public assistance in a suspicious death investigation

In a media release Saturday, the BC RCMP said the Southeast District Major Crime Unit is asking for the public's help after a 35-year-old woman was located deceased on May 6, 2021 in the southeastern part of the province.

RCMP said on Thursday May 6, 2021 the body of 35-year-old Brenda Ware was found 54 Kilometers northeast of Radium along Highway 93 in Kootenay National Park. 

RCMP said the BC RCMP Southeast District Major Crime Unit has taken custody of this suspicious death investigation.

“The investigation has determined that Ware was known to have been in in Didsbury, Alberta and traveled to Kootenay National Park, BC where her vehicle and body were discovered on May 6, 2021,” the RCMP media release said.

"Investigators are requesting assistance from the public and information from anyone who saw Brenda Ware from May 4, 2021 to May 6, 2021 or her vehicle a red 2019 Jeep Cherokee Alberta Licence Plate YPC553.”

RCMP said Brenda Ware is described as being 5"1 (155 cm), 108 pounds (49 kg), with blue eyes and brown hair.

"We are hoping someone may have seen Brenda or her car prior to her death," said BC RCMP Spokesperson Dawn Roberts.

"We would also like to speak to anybody who may have encountered hitchhikers in that area or has dash camera video of driving through Kootenay National Park on May 5th or 6th.”
