Nelson Police are forwarding charge recommendations to Crown counsel for two (2) counts of Indecent Act contrary to section 173 of the Criminal Code of Canada after a complaint was received of a male engaging in a lewd act in the area commonly referred to as Red Sands beach on Thursday, July 23, 2020.

In a media release, Nelson Police said the Nelson man was arrested without incident Friday, July 31 before being later released on an Undertaking.

“While it is routine for consenting adults to enjoy Red Sands in various states of dress, this subject was reportedly conducting himself in a manner that exceeds the comfort level of other beach goers and met the criteria for a Criminal Investigation,” the NPD release said.

Nelson Police said two suspects were originally identified at the outset of the investigation.

However, after further investigation, one of those males were clearly identified as being the perpetrator.

“During the course of this investigation another, similar incident was identified, also at Red Sands beach,” NPD said. “The suspect in that matter was determined to be the same male as this most recent incident.”

Police said at this time the department would like to thank the members of the public that made themselves available and assisted with this file.

NPD said pictures and statements were invaluable to concluding this file with an arrest and charge recommendation.

If anyone has further information about this incident, they are requested to contact Constable Caldwell at 250-354-3919, extension 659.
