UPDATE: Man convicted/sentenced after B&E and assault at Chameleon restaurant

On Sept. 7, Castlegar RCMP arrested 35-year-old Brandon Malkinson of Nelson in relation to this break and enter/assault matter (see coverage below). He was held in custody until his court appearance on Sept. 11, and on that date he was found guilty of two counts of break-and-enter, assault, and breach of probation, according to Castlegar RCMP Sgt. Laurel Mathew.

“We got a couple of good tips from the public, and then it was just boots-on-the-ground, round-the-clock police work, our guys going back-and-forth to Nelson, and eventually getting names,” she said. “Our guys were relentless that weekend.”

She said police took Malkinson to hospital, as he had been shot in the confrontation with the restaurant owner.

“His injuries weren’t dramatic, he was fit for incarceration right after receiving medical care,” Mathew added. “The restaurant owner has recovered from the assault.”

Today, Malkinson was sentenced in court to a term of imprisonment of 30 months.

“After careful consideration of all facts and circumstances in this case, police are not recommending charges against the restaurant/home owner,” Mathew added. “His actions were found to be within the bounds of reasonable force under the circumstances he was in, according to the law of self defence.  

“Police would also add that they don’t encourage people to take matters into their own hands if/when it’s possible to safeguard yourself and call 9-1-1.”

The Castlegar RCMP is currently investigating a break-and-enter, which occurred early Sunday morning at The Chameleon Restaurant in Castlegar. The suspect may be injured after being shot at by the complainant.

On Sept. 3, the Castlegar RCMP responded to a break-in enter at the Cameleon Restaurant. On arrival police were advised that the lone male suspect had fled and may be suffering from a gunshot wound. The owner stated to police that he resides upstairs at the restaurant and after being awoken by noise, he went to investigate arming himself with a small caliber handgun. The complainant said that suspect was wearing a brown hoodie, and had his face covered. During the confrontation, the complainant was bear sprayed and did discharge the handgun, possibly striking the suspect, who then fled.

RCMP investigators located clothing articles nearby, which they believe were associated to the incident. The suspect has not been identified or located and police would like to confirm the wellbeing of the suspect and ascertain further information as to what occurred.
